i In an 0GC July 6, 1989 memorandum I was requested to provide a status and

schedulc for complying with the requirements of the AEA Section 84a(3).

In this snemorandum it was indicated that the Court, as part of oral arguments on ar, EDF petition scheduled for September 25, 1989, would likely ask about the status of the subject comparability effort. The OGC memorandum also

. indicated that it would aid NRC's position, if counsel could reply that NRC and EPA were progressing to meet the obligatior.s.ir the AEA, Section 84a(3).

In order to continue progress towards the accomplishment of comparability of.

our. standards according to the Section 84a(3), we have transmitted the results of the RES comparability review to EPA. EPA may be able to provide to us some preliminary reaction prior to the September 25, 1989 court date; your offices will be informed of EPA's action.

Depending on the outcome of the oral arguments, we may be directed to proceed with accelerated rulemaking to comply with Section 84a(3) under the EDF request to promulgate a rule within a year's time.

In light of that possibility, by this letter I request that you assign an CGC staff member and a RES staff member, who along with the NMSS-assigned staff member, will develop a strategy and schedule leading up to accomplishment of the EPA /NRC Section 84a(3) Comparability requirement.
