LAC-12779, dated July 14, 1989.
In the letter referenced above, Dairvland Power requested an exemption from.the requirements of 10 CFR Part 26, Fitness-for-Duty Program.
Following our telephone conversation with members of your staff, we now understandLthat a request for exemption to the rule will not be necessary because on August 4, 1987, License No. DPR-45 waa amended to a possess-but-not-operate status and further amended'to a Full-Term Possession-Only License by Amendment No. 63 dated August 18, 1988.
Therefore, Dairyland Power is already exempt because of our SAFSTOR status. If the NRC's understanding is different than Dairyland's, please respond as soon as possible.
