Dear Mr. Taras:

The purpose of this letter is to take issue with certain statements made by you on page 2 of your letter to this office dated May 17, 1989.

Your letter states that "NRC and DA have agreed to have Army communications  :

with NRC come through . . . three offices." Authorization to contact the NRC also appears to be limited to three rather narrow areas for Army personnel.

While we have no objections to official Army communications normally coming to the NRC from certain designated offices, the Army must assure that all appropriate Army personnel are aware that this mode of normal communication in i no way restricts them from contacting the NRC directly with concerns about potential safety issues. I l

Information Notice 84-08 (February 14,1984) reminded licensees that the public health and safety requires that employees be free to raise safety issues to licensee management and to the NRC. Failure to permit employees to do so violates 10 CFR 30.7, 10 CFR 4C.7, 10 CFR 50.7, 10 CFR 70.7, and 10 CFR 72.10 regarding " Employee Protection" and may subject licensees to significant i enforcement action by the NRC.  ;

i You should review the Army's current procedures to assure that no such )

restrictions are present. If such restrictions are present, you should j promptly inform all appropriate employees.that the restrictions should be '

disregarded, that any employee may freely come to the NRC at any time without fear of any form of retribution and that such restrictions will not be enforced.

Please notify us no later than September 1, 1989, if any such restrictions have been identified and what the Army has done to assure that all appropriate Army personnel have been informed that such restrictions do not restri.ct such ,

personnel from contacting the NRC with concerns about potential safety j issues. .j i
