'The subject draf t Regulatory Guide (RG) is intended to provide licensees of nuclear reactors guidance concerning methods acceptable to the Nuclear Regulatory Commission (NRC) staff for complying with-the requirements of

.recent amendments to 10CFR50 regarding the amount of funds required for

decommissioning and funding methods. Public comments are being solicited on the draft RG. Toledo Edison appreciates the opportunity to comment.

Toledo Edison's comments relate to Appendix B of the Guide, '.' Recommended Vording:for Financial Assurance Instruments." Appendix B provides specific wording for the various types of financial instruments which may be used to comply with the rule. While the Guide refers to the language of these examples as recommended, it specifies.that licensees "should use the recommended wording." This vould seem to imply that use of the recommended language vill be considered mandatory. Toledo Edison is concerned that this veuld. reduce flexibility to use existing financial instruments which Previously have been established to comply with state public utilities

. commission decommissioning fund requirements and otherwise satisfy 10CFR50.75.

is not required;by'the rule. Specifically, a trustee who ir likely.not a NRC licensee, wouldlbe required to. ft"mish annually to the _ NRC, a statement confirming the value of the trust fund. Toledo Edison believes that'this

report, if.~it is desired by the NRC,'should be required by rule, not regulatory guidance. Such a report should be required only of licensees.and not third party trustees.
