APPLICANTS' OBJECTION IN THE NATURE OF A MOTION H LIN H E TO A PORTION OF THE PREFILED TESTIMONY OF GUY DAINES Applicants move this Board in the nature of a motion in limine to exclude as evidence in the proceeding a portion of the " Commonwealth of Massachusetts Testimony of Guy Daines on the Inadequacies of the SPMC As It Pertains to Special Populations in the Emergency Planning Zone."
In support of their motion, Applicants say that the section of testimony in question is not material or relevant to any issue presently before this Board.

At page 10 of his testimony, in the last full sentence on the page, the witness states that "There is also no 8905020017 890418 T

l evidence of any TDD for the hearing impaired as part of that communication system that supports the emergency operation center."
This sentence is irrelevant to the issues being 1
litigated.
On February 7, 1989, Applicants agreed to install 1
the TDD system which the Attorney' General for the Commonwealth of Massachusetts
(" Mass AG") had suggested in l
his contentions, and in exchange Mass AG withdrew the contention on point, JI 40.1 Egg Joint Stipulation Regarding Status of Admitted Contentions at 8 (February 7, 1989).
Therefore, no issue concerning notification of the hearing impaired is presently before this Board, and the sentence'in question should be excluded as irrelevant.
