-PROPOSED IMPOSITION OF CIVIL PENALTY - $50,000 This is to inform the Commission that a Notice of Violation and Proposed Imposition of Civil Penalty in the amount of Fifty Thousand Dollars ($50,000) will be issued on or about April 21, 1989 to Northeast Nuclear Energy Company.
This action is based on a violation of the equipment qualification requirements of 10 CFR.50.49.
In'accordance with the " Modified Enforcement Policy Relating to 10 CFR 50.49," contained ir Generic Letter 88-07, the. violation has been categorized as a' Category C violation. The mitigation and escalation factors
'of the modified enforcement policy were considered and because of the licensee's identification of the problems and corrective actions the minimum civil penalty set forth in the policy _is proposed in this case.
It should be noted that the licensee has not been specifically informed of the enforcement action. The schedule of issuance and notification is:
