MINUTES OF CRGR MEETING NUMBER 143
[
-The Committee to Review Generic Requirements (CRGR) met on Wednesday, August 3, 1988 from 1-4 p.m.
A list of attendees for this meeting is attached (Enclosure 1). ~The following item i<as d ressed at the meeting:
Brian Grimes (NRR) presented for CRGR review a proposed Fitness-for Duty l'-
Rule. This proposed rule was reviewed previously and endorsed by CRGR at Meeting No. 131.
It has been revised to reflect subsequent Commission comments. The Committee recommended in favor of fonnrJing the' proposed rule to the Commission, subsequent to' modifications (to be coortiinated with the CRGRstaff). This matter is discussed in Enclosure 2.
'In accordance with the EP0's July 18, 1983 directive concerning " Feedback and Closure of CRGR Reviews," a written response is reqaired from the cognizant office to report agreement or disagreement with the CRGR recommendations in these minutes. The response, which is required within five working days'after receipt of these minutes, is to be forwarded to the CRGR Chairman and if there is disagreement with.CRGR recommendations, to the EDO for decisionmaking.

. to the Minutes of CRGR Meeting No.143 Propo_ sed Fitness for~ Duty Rule TOPIC B. Grimes (NRR),R.Erickson(NRR),andL. Bush (NRR)presentedforCRGRreview a proposed Fitness for Duty Rule.- This rule was previously reviewed by the 11, 1988. This revision reflects changes Committee at Meeting 131 on March incorporated as a result of Commission discussion of the proposed rule. The intent of this rule is to increase the assurance of public health and safety at nuclear power plants by removing from unescorted access personnel who are-This includes the improper use of alcohol, judged to be unfit for duty.

BACKGROUND The proposed rule was sent to CRGR members with the staff requirements memo dated July 18, 1988 directing the staff to incorporate several modifications.
CONCLUSIONS / RECOMMENDATIONS The Committee discussed the proposed rule with the statt and made the following recommendations.
The committee expressed concern that the inclusion of medical conditions 1.
should not infer the same problem as drug abuse. The two issues should be treated separately to provide this distinction.
The language on page 110 in section 26.27(b)(3) should be revised to 2.
remove the phrase, " competent medical authority concludes, in writing, that the problem is unlikely to recur." The staff agreed that language on page 109, section 26.27(b)(1) would be more appropriate.
The period of records retention in section 26.71(c) should be modified 3.
from five years to the termination. of the license, similar to language in The staff agreed to clarify this ection to include section 1!6.20.
26.27(b)(1) and (b)(3) as well as (b)(1) and add the phrase, "for three years or longer" to the phrase "made ineligible for assignment."
The Commission paper should be modified to include the sentence on page 5 4.
of Enclosure 1 (item 14) to emphasize that a finding could be made that the rule is needed for adequate protection. Also, state that CRGR has reviewed the changes and recommends forwarding to the Commission.
As a result of their review of this matter, including discussions with the staff at this meeting, the Committee recommended in favor of forwarding the J
proposed rule to the Commission subject to incorporation of the preceding comments.
