INCENTIVE REGULATION OF NUCLEAR POWER PLANTS BY STATE PUBLIC UTILITY COMMISSIONS - UPDATED REPORT, SEPTEMBER 1987 In SECY-85-260, subject as above, the staff informed the Commissioners of its effort to track nuclear power plant performance incentives established by State public utility comissions (PUCs), develop a data base, evaluate possible safety' effects, and provide periodic reports of its findings. The Office of i Nuclear Reactor Regulation is tracking the incentives and has prepared a plant-specific report on the methodology and potential financial costs of the incentives (Enclosure). This current report updates information in a report dated July 1986, and is comprehensive; reference to the July 1986 reporc is no longer necessary. Performance incentives,are shown to be now applicable to the construction or operation of about 45 reactors in 17 States.

We are continuing to monitor developments at State PUCs and utilities to provide updated information for subsequent reports. It is planned that the report will be updated and distributed periodically. Your comments on the enclosed report and suggestions for future reports are requested.
