SAFETY EVALUATION REPORT, APPLICATION DATED APRIL' 18, 1989

'l Background i By letter dated April 18, 1989, All Chemiol Isotope Enrichment, Inc. (AlChemIE) requested that- the latest date for complettn of the modification of AlChemIE Facility-1 CPDF in construction permit CPEP-1 be changed from May 3,1989 to November 3, 1989. . The work to be accomplished under CPEP-1 is modification of-the existing Centri ~ age Plant Demonstration Facility (CPDF) on the grounds of the U.S. Department of Energy's (DOE) Dak Ridge Gaseous Diffusion Plant at Oak Ridge, TN. 'The modification is to provide'new physical security' access controls (separating access control for the CPDF from that of DOE's Oak Ridge Gaseous Diffusion Plant) and installing other security measures. Minor changes will also be made in the CPDF to enable it to enrich stable isotopes, rather than uranium. AlChemIE has not yet begun to modify the CPDF because AlchemIE has

, not yet concluded its lease agreement with the Departrent of Energy.

Discussion When an operating license has been received, AlchemIE will use the existing gas I centrifuge machines already installed in the facility to enrich stable isotopes rather than uranium. The construction permit CPEP-1 permits A1ChemIE to take possession of classified gas centrifuge machines, to transport them as necessary, and to test not more than two machines in the CPDF. It also' permits AlchemIE to make the necessary modifications to the physical security systems and ,

1 install other security measures, in accordance with the' approved security plan. j Before A1ChemIE can accomplish the modifications, it must fir-t conclude a l lease agreement with 00E, owner of the existing CPDF. The wyk~ of modifying the CPDF has been postponed, pending conclusion of the lease agreement. It is considered that the delay in concluding the lease, which is beyond the control 1 of the permit holder, constitutes good cause for a reasonable. extension of the latest date for completion of the modification of the facility.

Both the authorized modifications to tne facility and the proposed operation of the facility involve no.significant health and safety matters involving licensable radioactive materials; the construction permit was granted on the basis of review of common defense and security considerations, and of environmental considerations. There is no feature of the modifications 1

authorized under CPEP-1 which, if delayed or performed over a reasonable

2 June 20, 1989 extension in time period, causes any appreciable change with respect to effects I on the common defense and security, on health and safety, or on the environment. The proposed amendment for_ a reasonable extension of the time -

period for completion of the modifications, involves no unreviewed safety questions, no significant environmental impacts or changes in the impacts, and no irreversible consequences.

This licensing action was discussed with William Cline, Region II.

Conclusion The staff.has' determined that the proposed change in the latest date for completion of the work under the construction permit CPEP-1 will not be inimical to the common defense and security, that it will not have a j significant detrimental effect on the public health and safety nor on the environment, and that the licensee has shown good cause for the proposed ,

change. Extension of the latest completion date from May 3,1989 to November 3, '

1989, is reconsnended.
