This refers to the routine safeguards inspection conducted by
Mr. W. K. Lancaster of this office on February 27 - March 3, 1989, at the

Indian Point 3 Nuclear Power Plant of activities authorized by NRC License

No. DPR-64, as well as to an. event that was reported March 24,'1989 involving
I
an unauthorized person gaining access to the plant protected area. This also
'
refers to the discussions of our findings held by Mr. Lancaster with you and
other. members of your staff at the conclusion of the inspection.
Areas examined during this inspection are described in the NRC Region I
Inspection Report which is enclosed with this letter. Within these areas, the
inspection consisted of selective examinations of procedures and
representative reccrds, interviews with personnel, and ' observations by the
inspector.
The enclosed inspection report identifies five apparent violations of NRC
requirements. We are concerned ~about these matters because they are
indicative of degradations in the implementation of your security program and
reflect possible significant program weaknesses. Additionally, the event
which was reported to the NRC on March 24, 1989, is very similar to a violation
cited during NRC Inspection 50-286/88-22 (December 1988 and January 1989).

reported by you on February 5,1989, which was followed up during this
inspection and resulted in a potential violation. That event involved leaving
a gate in the protected area barrier unlocked for a period of about fifteen
hours, even though the area was being patrolled and the gate was found unlocked
by a member of the security force on a patrol about mid-way through that
period.
In addition, we are concerned about the impact that increased
overtime by the security staff has had on the apparent violations identified
during the inspection.
Therefore, we have scheduled an Enforcement Conference to discuss these matters
on April 28, 1989, at 1:00 p.m., in our office. Arrangements for the Conference
were made between Mr. J. Russell of your staff and Mr. Peter Koltay of this
, office on April 10, 1989.

At the Conference, you should be prepared to discuss these matters, in detail,
including their causal factors and the corrective actions undertaken or planned
to prevent recurrence,as well as the unresolved items described in the enclosed
.inspectionLreport. You should also be prepared to discuss why the events
reported to the NRC on February 5 and March 24, 1989 were not reported within
one hour of discovery as required by 10 CFR 73.71. ' Decisions regarding
appropriate enforcement action for these mattrms will be made subsequent to the
Enforcement Conference and will be transmitted to you separately.
Certain paragraphs in the enclosed inspection report contain details of your
security program that have been determined to be exempt from public disclosure
.in accordance with 10 CFR 73.21 (Safeguards Information). Therefore, those

paragraphs will be deleted from the inspection report placed in the NRC Public
Document Room with this letter, and will receive limited distribution.
