Dear Governor Dukakis:

, I have received your letter of April 27th, and I deeply regret that I must once again inform you that you have been ill-served by members of your staff regarding the Pilgrim Nuclear Power Station. I feel compelled to apprise you of'the_ facts in this matter, as I did in my letter, dated January 26, 1989, in response to yours of January 17, 1989.

On Monday, April 24, 1989, a compliance inspection was conducted by two inspectors from the Department of Public Safety. Late Monday afternoon, the inspectors' issues of concern were orally reported to my staff. By close of business Tuesday, we had addressed all of the concerns; and by Wednesday morning, April 26, supporting documentation was hand-delivered to the Department of Public Safety in Fall River. The documents were accepted by Mr. Michael S. O'Brien's secretary.

On Wednesday afternoon, April 26, a call came from the Department of Public Safety requesting the address of the official to whom the written report should be sent, and we provided the requested information. We received no further communication until I received your letter by telecopy late on the afternoon of April 27.

Because of your expressed concern, we immediately called the Department of Public Safety and requested the report to which you referred because we had not received it. The Department replied that.it was placed in the U.S. mail at noon today. We requested a telecopy of the report so that we could ensure that we had addressed the pertinent items. He were told that this could not be done without authorization from higher authority. About one hour later, we received a telecopy of the report. No issues were identified in the written report other than those that were addressed in the

~ documentation provided to the Department of Public Safety on April 26.

Therefore, there was no need to raise a concern in your mind.

.Page Two To help you understand the situation. I have appended and highlighted a copy of the report and of the portion of the documentation delivered on April 26 which addresses the Massachusetts Code issues identified in the report.

Let me assure you that we are in compliance with applicable regulatory requirements. Accordingly, when we are satisfied that we are ready, we will restart Pilgrim.
