Shannon, Attorney General for the Commonwealth.of
-j Massachusetts Regarding Communication Deficiencies"
[ hereinafter " Testimony").- In support of their motion, Applicants say that the portions of the Testimony in question-J are not material or relevant to the issues before this Board.
ARGUMENT Three portions of the Testimony are not material or.
relevant to any issue presently before this Board.
First, on page 2, lines 13-16, the clause beginning " deficiencies in 8906220114 890613 ~

the SPMC's provisions for rapid response..." asserts that there are deficiencies in the'SPMC's procedures for rapidly responding "to information received and' transmitted by field workers."
This testimony is outside the scope of any.
admitted contention or basis.
JI Contention 31 only alleges that the communication network'will result in an untim'ely' response.
It does not allege any deficiency in the SPMC procedures once the'information is received.
- Moreover, Applicants were'not put on notice of this allegation through Mass AG's responses to discovery.
This portion of the l
1 Testimony should be excluded.
Second, the first full paragraph on page 7 alleges that i
i there is a " problem with respect to coverage for the Emergency Medical System Service."
This_ testimony is also outside the scope of any admitted contention or basis.

EX-8 Basis B.3 is the only basis alleging a range deficiency.

i That basis, however, only alleges a deficiency in the range i
.1 of the ERN system as it applies to communications with school evacuation buses.on route from the bus yards.
No other basis alleges a deficiency in EMS range, nor did Mass AG raise this issue in any of his responses to discovery.
Consequently, this portion of the testimony is irrelevant and should be l
excluded.
Third, on page 11, the first full paragraph of the section of the Testimony entitled " PROCEDURES" claims that there is a deficiency in NHY ORO's priority system.

MAG EX-8 Basis B.4 is the only basis that. deals with

channel overloading, That basis, however, does not allege any deficiency in the priority system.
