Dear Mr. Cobban:

This refers to the special, unannounced radiation safety inspection conducted

by Mr. Van R. Scovill of NRC's Region IV Uranium Recovery Field Office on

February 28, 1989, at your Williston, North Dakota, facility. The inspection

examined reciprocity activities authorized by 10 CFR 150.20. The findings of

our inspection were discussed with you on February 28, 1989. The enclosed NRC

Inspection Report 15000033/89-01 documents this inspection.

The inspection was an examination of activities conducted under the general

license as they relate to radiation safety and to compliance with the

Commission's rules and regulations and the conditions of the license. The

inspection consisted of selective examinations of procedures and representative

records, interviews of personnel, independent measurements, and observations by

the NRC inspector.

During this inspection, certain of your activities appeared to be in violation

of NRC and North Dakota Department of Health requirements. While these

apparent violations were identified by the NRC inspector, they appear to have

occurred as a result of activities authorized by the North Dakota Department of

Health, Radioactive Material License Number 33-16105-02. Therefore, a copy of

this report will be forwarded to the North Dakota Department of Health for

review.

Our inspector also verified the steps you have taken to correct the violations

brought to your attention during our previous inspections, which were conducted

on September 1 and October 5-6, 1988. A discussion of our review of your

corrective actions is provided in the enclosed NRC Inspection

Report 15000033/89-01.

In accordance with 10 CFR 2.790 of th' Commission's regulations, a copy of this

letter and the enclosed inspection report will be placed in the NRC's Public

Document Room.
