ENCLOSURE 1 NOTICE OF VIOLATION System Energy Resources, Inc.

Docket No. 50-416' Grand Gulf License No NPF-29 During ' the Nuclear Regulatory Commission (NRC)' inspection conducted' on March 29-31,and April 19-21, 1989, violations of NRC requirements were identified. 'In accordance with the " General Statement of Policy and Procedure.

for NRC Enforcement Actions," 10 CFR Part 2, Appendix C (1989)', the violation are listed below:

A.

Technical Specification 6.12.1. in part requires that any indiv'idual or group'of individuals permitted to enter High Radi6 tion Areas (greater than 100 mrem /hr) shall be provided with or accompanied by one or more of the following:

1.

A radiation monitoring device which continuously indicates the radiation dose rate in the area.

2.

A radiation monitoring device which continuously integrates. the radiation dose rates in the areas and alarms when a preset integrated-dose is received.

Entries in to such areas. with this monitoring device may be made after the dose rate levels in the area have been established and personnel have been made knowledgeable of them.

3.

A health physics qualified ' individual, i.e., qualified in radiation protection procedures with a radiation dose rate monitoring device, who is responsible for providing positive control over the activities within the area and shall perform periodic radiation surveillance at the fregeency specified by the unit Health Physicist in the Radiation Work Permit.

Contrary to the above, on March 28, 1989, tt,e inspector observeo a contract worker entering the RHR "A" Pump Room en the 133 foot elevation of the Auxiliary Building, a high radiation area (greater than 100 mrem /hr) witheut being provided with or accompanied oy one or more of the above l

requirements.

This is a Severity Level IV violation (Supplement IV).

B.

Technical Specification 6.8.1 requires that written procedures shall be established, implemented, and maintained in accordance with Regulatory Guide 1.33, Appendix A, Revision 2, dated February 1978.

Section 7.e(2) of Regulatory Guide 1.33 describes radiation surveys.

l Administrative Procedures, Exposure and Contamination Control, 01-5-08-2, Revision 18, dated October 27, 1988, Section 6.27.b requires that all material used in Contamination Areas must be surveyed for contamination by Health Physics (HP) or by Radiation Worker 11 qualified personnel under l

the direct supervision of HP personnel.

L Contrary to the above, during the current Refueling Outage, in April 1989, l

tools and equipment wcre surveyed by Radiation Worker II qualified personnel in the Hot Machine Shop / Decontamination Room without HP direct supervision.

This is a Severity Level-IV violation (Supplement IV).

C.

10 CFR 30.41(c) requires each licensee, before transferring byproduct material to a specific licensee of the Commission or an Agreement State or to a general licensee who is required to register with the Commission or with an Agreement State prior to receipt of the byproduct material, to verify that the transferee's license authorizes the receipt of the type, form, and quantity of byproduct material to be transferred.

State of South Carolina Radioactive Material License No. 097, License Condition 46 issued to Chem-Nuclear Systems, Inc. (CNSI),-prohibits the licensee from receiving waste containing chelating agents with concentrations greater than 8 percent by weight.

Radioactive waste containing chelating agents within the range of 0.1 to 8 percent by weight shall not be accepted by the licensee unless solidified with media specified in License Condition 33.

The concentration limits apply to waste prior to solidification; dilution by solidification means is not allowable.

Contrary to the above, the licensee transferred a shipment of byproduct material to CNSI and upon receipt on April 27, 1988, the State of South Carolina determined that the Radioactive Material Waste Shipment No. C488-115, classified es solidified resin containing cheleting agerts, packaged in a steel liner transported as " exclusive use" on a flatbed trailer, was found to be improperly solidified.

The resin was not bound within the solidification media matrix.

This is a Severity Level IV violation (Supplement V).

Pursuant to the provisions of 10 CFR 2.201, System Energy Resources, Inc. is hereby required to submit a written statement or explanation to the Nuclear Regulatory Commission, ATTN: Document Control Desk, Washington, DC 20555, with a copy to the Regional Administrator, Region II, and a copy to the NRC Resident Inspector, within 30 days of the date of the letter transmitting this Notice.

This reply should be clearly marked as a " Reply to a Notice of Violation" and should include for each violation:

(1) admission or denial of the violation, (2) the reason for the violation if admitted, (3) the corrective steps which have been taken and the results achieved, (4) the corrective steps which will be taken to avoid further violations, and (5) the date when full

License No. NPF compliance will be achieved.

Where good cause is shown, consideration will be given to extending the response time.

If an adequate reply is not received within the time specified in this Notice, an _ order may be issued to show cause why the license should not be modified, suspenued, or revoked or why such other action as may be proper should not be taken.
