Dear Mr. Hoate:
TheNuclearRegulatoryCommission(NRC)needstoobtaininformationrelatedto components that are reported to have been produced by Control Valve Specialists, Inc. and procured for use in a nuclear power plant. The NRC routinely conducts inspections of persons and organizations to assure that NRC licensees are con-ducting their activities in conformance with NRC requirements and that their activities assure adequate protection of the public health and safety. Certain NRC requirements also apply to individuals and companies (vendors) which provide services, equipment, and materials to NRC licensees as those services, equipment, and materials may affect the ability of licensees to provide protection of the public health and safety.
Inspections of vendors are routinely conducted to assure that the vendors of these services equipment, and materials are conform-s ing to applicable NRC requirements such as the reporting and defect evaluation requirements of Title 10 of the Code of Federal Regulations (10 CFR) Part 21 or specific requirements as nay be invoked by NRC licensee procurement documents.
For example, NRC licensees, in their procurement documents, may require the vendor to establish and implement a quality assurance program as provided by 10 CFR Part.50, Appendix B.
The NRC is, in general, authorized under Section 161c. of the Atomic Energy Act of 1954, as amended (AEA), to obtain such information as it may deem necessary or proper to assist it in administering or enforcing the AEA and NRC regulations.
The NRC is authorized under Section 206(d) of the Energy Reorganization Act of 1974, as amended (ERA), to conduct inspections to insure compliance with the provisions of Section 206 of the ERA. Section 206 requires certain individuals to report information reasonably indicating that a nuclear power plant, or a basic component supplied to such a plant, (1) fails to comply with the AEA or any NRC rule, regulation, order, or license, or (2) contains a defect which could create a substantial safety hazard, as defined by regulations which the NRC has promulgated. The NRC's regulations in the area are codified in 10 CFR Part 21.
Information available to the NRC suggests that certain components, identified in the enclosure to this letter, supplied by you, may create a safety concern at commercial nuclear facilities. An inspection is required to determine whether l'
or not this is the case.
In this particular case, it is necessary for the NRC to inspect your facilities to determine the extent to which you have supplied l
components for use in nuclear power plants.

This inspection is therefore necessary to assess whether there continues to be reasonable assurance that ti.e public health and safety is adequately protected.
This NRC inspection is to be conducted pursuant to the above authority. Should you refuse to permit this NRC inspection to be freely conducted, the NRC will be unable to determine the adequacy of the components identified in the enclo-sure to this letter and supplied by you for use in nuclear power plants. Absent the additional ;rformation which we seek, in part, through the inspection of your facility, we must presume that the use of the identified components in nuclear power plants undermines our reasonable assurance that there is adequate protection of the public health and safety.
In addition, other components and/
or services supplied by you for use in nuclear power facilities may also be called into question. Should you refuse to pennit this inspection, the NRC may exercise its authority under Section 161 of the AEA to direct licensees of com-mercial ruclear power plants to:
1.
Cease purchasing the identified components which you supply, from you or anyone else for use in nuclear power facilities, 2.
Cease installing the identified components supplied by your company in nuclear power facilities, and 3.
Determine the adequacy of all other components supplied by your company for use in their nuclear power facilities.
We require and appreciate your cooperation in this serious matter.

The Nuclear Regulatory Commission (NRC) needs to obtain information related to components that are reported to have been produced by Control Valve Specialists, Inc. and procured for use in a nuclear power plant. The NRC routinely conducts inspections of persons and organizations to assure that NRC licensees are con-ducting their activities in conformance with NRC requirements and that their activities assure adequate protection of the public health and safety.
