Dear Mssrs. Reynolds and Stenger:

In response to your letter dated February 7, 1989, I wish to express my appreciation to you for communicating NUBARG's concerns regarding a proposed generic letter on fraudulent material.

Subsequent staff action has been to revise this letter to not require a response.

The Committee to Review Generic Requirements considers all generic letters which require responses under Section 50.54(f) to determine whether they meet the intent of the regulation in the type of information requested.

In general, a generic letter requires a response under Section 50.54(f) but does not otherwise require actions to be taken.

This distinction of what action is required vs. the action requ'ested in a generic letter is also the explanation for your question on why a backfit analysis is not done for generic letters.

A backfit analysis in accordance with 10 CFR 50.109 must be performed when a new staff position or requirement is imposed other than those set forth in 50.109(a)(4).

Generic letters do not impose new staff positions or requirements; only studies or analyses directly related to the requested information is required.

Thus, the full regulatory analysis of 50.109(a)(2) and (3) is not needed.

10 CFR 50.54(f) calls for a more limited assessment to assure that the safety significance of the matter warrants the burden associated with the response.

The determining factor in this regard is not the type of information requested, but only whether addressees are required to take any action apart from the studies or analyses associated with supplying the requested information.
