REQUEST FOR HEARING BY ATLAS CORPORATION ON. DENIAL i OF ITS APPLICATION TO RENEW ITS SOURCE MATERIALS LICENSE

Discussion: On July 31, 1987, Robert D. Martin, Regional Administrator, RIV, denied the application of Atlas Minerals Division of Atlas Corporation

(" Atlas" or " Licensee") to renew its source materials license, SUA-917, under which it had operated uranium milling faciligies at Moab, Utah.

Accompanying the denial was an immediately effective Order requiring Atlas to continue activities needed to keep the site in a safe condition and to prepare for decommissioning and reclamation activities.

The denial of the license renewal was premised on Atlas' failure to meet the requirements of 10 CFR Part 40, Appendix A, Critoria 9 and 10, for a surety arrangement for decommissioning and reclamation of its site.

On August 27, 1987, Atlas requested a formal 14 hearing before a three-person Licensing Board 4tgAOSg904 pDB panel using the formal hearing procedures of ggY 126 10 CFR Part 2, Subpart G. Attachment B.

I In SECY-87-158, the Commission approved the NRC staff's denial of Atlas' renewal application and the associated order.
