Your letter to Chairman Zech, dated March 20, 1989, recommended that the j

U.S. Nuclear Regulatory Commission (NRC) work to establish itself as the sole l

regulator of mixed radioactive and hazardous waste.

In connection with l

NRC and the Environmental Protection Agency (EPA)y Amendments Act, both hearings on the Low-Level Radioactive Waste Polic indicated a preference for single-agency regulation of mixed waste.

In spite of this, Congress did not elect to provide for single-agency regulation of mixed waste, and knowingly allowed mixed waste to be subject to dual regulation by both NRC and EPA.

Although we agree that dual regulation is problematic and burdensome, we have no choice but to make dual regulation as workable as we can. Toward this end, we are continuing to work with EPA to provide joint guidance on particular areas of mixed waste regulation.
