Dear Mr. Baublitz:

In February 1987, the Department of Energy (DOE) published " Recommendations for Management of Greater-Than-Class C Low-Level Radioactive Waste (GTCC waste)"

(D0E/NE-0077). This report states that DOE expects to have a program in place for accepting GTCC waste for storage within two years.

I would like to reiterate our support for this program.

We see a clear need for Federal interim storage capacity for GTCC waste. As we have discussed with your staff, we have a situation in which Nuclear Regulatory Commission (NRC) and Agreement State licensees must store GTCC waste for an indefinite period, pending availability of disposal capacity. We believe that this situation may result in incidents in which control over the stored radioactive material is lost, possibly resulting in severe radiation exposures to individuals. We note that in other countries, lost and abandoned sealed sources have resulted in fatalities.

Thus, we would appreciate your written clarification of your plans for accepting GTCC waste, and in particular, confirming when you expect GTCC waste acceptance to connence. We would also appreciate additional information about your development of fees for GTCC waste acceptance. Many licensees possessing GTCC waste have limited resources; some are in serious financial difficulties. We believe, therefore, that the fees for GTCC waste acceptance should be set in a manner that assures access of all licensees to the Department's storage service.
