Export License Application XW024 (Docket Number: 11006354)

Dear Mr. Quayle:

After discussing the details of the subject export license application during a conference call on August 20, 2020, the NRC has determined that a specific license is not required to return the portions of the primary heat transport pump assemblies described in the subject export license application. These used pump assemblies do not constitute complete reactor primary coolant pump systems described 10 CFR Part 110 Appendix A, Item 4. They are authorized for import from Canada under the 10 CFR Part 110.27 general license for refurbishment, re-use and return to Canada, and therefore do not meet the definition of radioactive waste in 10 CFR Part 110.2.

The portions of the pumps that are found acceptable and then refurbished for potential re-use are authorized for return to Canada under the 10 CFR Part 110.26 general license, and subject to the reporting requirements in 10 CFR Part 110.54. The final decision as to whether the components will actually be re-used is made in Canada.

The NRC understands that if the contaminated pump assemblies and/or portions thereof are deemed unacceptable for refurbishment and re-use, they may be returned to Canada in their entirety without treatment or they may be sent to the EnergySolutions facility in Oak Ridge, TN for treatment including metal recycle and volume reduction. The unusable contaminated pump assemblies and/or residual materials generated during the treatment processes, are considered radioactive waste, and may be exported (returned) to Canada to the extent the materials are identified and authorized for export by the existing NRC license, XW010/03. That license remains active in timely renewal status as the NRC reviews and processes an amendment to extend the expiration date and make other changes to that export license.
