Section H.6, Security, is deleted in its entirety and replaced by new Section H.6, as

New Section H.10, Security Background Investigations (B1), is added as shown on page two of this modification.

acquire, proprietary data (trade secrets) or confidential or privileged technical, business, or financial information, including Commissi on pl ans, policies, reports, financial plans, internal data protected by the Privacy Act of 1974 (P.L.93-579),

or other information which has not been released to the public or i

has been determined by the Commission to be otherwise exempt f rom disclosure to the public.

Contractor agrees to hold such.

information in confidence and not to directly or indirectly duplicate, disseminate, or disclose such information in whole or in part to any other person or organization except as may be necessary to perform the work under this contract.

Contractor agrees to return such information to the Commission or otherwise dispose of it either as the Contracting Officer may from time to time direct during the progress of the work or in any event as j

the Contracting Officer shall direct upon completion or i

termination of thi s contract.

Failure to comply with this clause shall be grounds for termination of this contract.

i H.10 Securi t y_ pac tgrgund _ Investi g ati ons_ (@I )

All contractor employees performing or scheduled to perform assigned or ordered tasks which require access to the Department of Justice computer system must complete and submit to NRC's Di vi si on of Security, through the NRC Project Officer, a properly completed personnel security forms packet for a

background investigation (BI) to allow access to the Department of Justi ce 's computer system.

The contractor shall assure that all forms are

accurate, complete, and legible (except for Part II, Personnel Security Questionnaire, which is required to be completed in private and submitted to the contractor in a sealed envelope). A favorable review of the information developed by the BI is necessary for access to the Department of Justice's computer system.

Initial eligibility for access shall be determined by NRC in accordance with the criteria and procedures set f orth in 10 CFR Part 10, which is hereby incorporated by reference and made a

part of this contract as though fully set forth herein.

The final determination on eligibility for access shall be made by the Department of Justice in accordance with their regulations.
