Dear Mr. McIntyre:
By your letter (DCP/NRC-1324), dated April 3,1998, Westinghouse submitted a response to the I
U.S. Nuclear Regulatory Commission (NRC) regarding inspection no. 99900404/97-02 and requested that the response be withheld from public disclosure. Westinghouse's request was made in accordance with 10 CFR 2.790 and was supported by an affidavit (AW-98-1223),
i executed by you on April 7,1998. The request was denied by my letter dated July 13,1998.
By your letter (DCP/NRC-1324, Rev. 2), dated August 21,1998, Westinghouse submitted a revised response to inspection no. 99900404/97-02, which contained all of the substantive information provided with the DCP/NRC-1324 letter, and requested the NRC to destroy Rev.1 of DCP/NRC-1324. We have determined that Westinghouse's revised response provides all of the information necessary to support the NRC staff's previous conclusions on the unresolved issues from inspection no. 99900404/97-02. Therefore, the origirial DCP/NRC-1324 letter is not needed to support the NRC staff's final safety evaluation report for the AP600 design.
By your letter (DCP/NRC-1434), dated August 27,1998, Westinghouse requested that the NRC l
destroy TP/NRC-1324. Because this letter is no longer needed for the AP600 review, the NRC wi!! destr y all copies of DCP/NRC-1434 and Rev.1 of DCP/NRC-1324 in its possession.
