Dear Mr. Murley:

Reference (a) provided our notification to withdraw our1

- applications-for amendment to Facility Operating Licenses NPF-66 and NPF-72

'and construction Permit CPPR-133. These applications addressed commonwealth Edisons plan to establish a wholly-owned subsidiary to be added to the licenses / construction permit as co-licensee. Reference (b) provided the NRC counsel's review of' reference (a) and questioned our desire to withdraw the application. The purpose of this letter is to clarify that we are withdrawing our applications as presented in the references to reference (a).

In:a related matter, commonwealth Edison submitted, on August 21,

-1987, to the Illinois Commerce Commission (ICC), a request for rehearing of our 9.6 percent rate freeze settlement agreement that would place Byron

-Station Unit 2 and Braidwood Station Units 1 and 2 under the wholly-cwned subsidiary. Concurrently, commonwealth Edison requested the ICC for an increase in base rates of approximately 27 percent, to address under normal

a T.E. Murley September 8, 1987 rate making procedures the recouping of the construction costs for Byron Unit 2 and Braidwood Units 1 and 2.

On September 3, 1987, the I.C.C.

indicated that they would deny the request for rehearing. A written order from the I.C.C. stating this is forthcoming.
