8/24/98 - Commissioner McGaffiaan's comments on SECY-98-176:

I approw 'he staff's recommendation of Option 1, which generally continues the current very f

modest level of NRC oversight in the area of maintaining a safety-conscious work environment (SCWE). I believe that it is important within the " minimal costs" of Option 1 to carry out the staff's previous commitment to assess SCWE as part of our assessment process and 40500 inspections. In the case of Millstone, we are specifically relying on next year's 40500 inspection to evaluate the licensee's program. More broadly, while I agree with Commissioner Diaz (and NEl and UCS) that the necessary mechanisms are in place to ensure that licensees maintain a safety conscious work environment. I believe that these mechanisms need to include the modest Option i efforts, such as the IP 40500 guidance, and that these efforts should not be discontinued.

I Given our budget constraints, I do not support the more resource-intensive options (Options 2-5) discussed in the paper.

The Commission has approved Option 1 which provides for: (1) assessing the work environment at licensee's facilities on a case-by-case basis, and (2) encouraging or ordering, on a case-by-case basis, a licensee to conduct a survey of its safety conscious work environment on its own or by a third party, and to report the results to the NRC. This is a continuation of the l

J current policy, with the addition of the development and implementation of additional guidance and training to inspectors in support of more complete and consistent program implementation.
