Dear Ms. Garde:

This letter responds to yours dated August 24, 1987, inquiring about a July 13,1987 meeting between NRC staff at the Comanche Peak site and rep-resentatives of the Texas Department of Lab and Standards, Boller Divi-sion, reported in the "NRC Staff's Sixth Progress Report and Annotated Bibliography" at p. 7.

You asked why the meeting was not public.

I have been informed by the Staff that the meeting between the representa-tives of the State and Federal agencies was simply a brief courtesy visit by the Texas representatives during a week of auditing at Comanche Peak and that no substantive discussions were held.

This is reflected in the attached letter from the State representatives.

As Indicated in the Staff's Sixth Pro-gress Report, the discussions concerned only the various responsibil.itics and activities of the two agencies at the Comanche Peak site regarding compliance with the ASME Bo!!er and Pressure Vessel Code.

The purpose of the meet-ing was simply to acquaint the representatives of the agencies with each other and with their assigned responsibilities.

Such meeting is not subject to the open-meeting policy.

' Chapter 65 65.102. ~NOCLEAR BOILERS.

'(a)

Nuclear boilers shall be inspected inservice by the owner or. user in accordance with American Society of Mechanical Engineers (ASME) Boiler'and Pressure Vessel Code,Section XI.

(b)

The owner or user shall engage the services of an Authorized Inspection Agency, qualified in accordance with Ameri-can National Standards-Institute /American -Society of' Mechanical

. Engineers (ANSI /ASME) N626.1, licensed by the Texas State Boarc of Insurance, and authorized to provide inspection services by the commissioner.

(c)

The chief inspector.shall assign, after receipt of; the completed N-3 Owner's Data Report, a state serial number to the nuclear boiler.

(1)' All N-5 Data Reports for piping systems and N-3 Owner's Data Reports shall be filed with the chief inspector.

(2)

National Board registration described in Sec-tion 65.15(4) or Section 65.16 of this title (relating to Man-ufacturer's Data Reports) is not required.

(d)

The Certificate of Operation will be issued after receipt of the preservice inspection summary report and prior to-l commercial service.,

The summary report shall include all activi-ties required by Section XI, except for the results of examina-tions or test of items obtainable only during power ascension s

Boiler Division Chapter 65 testing.

.These items shall be filed as an amendment to the sum-mary report within 60 days of the completion of the power ascen-sion testing.

The items identified to be submitted in the amend-ment shall be' agreed upon by mutual consent as provided for in 1

subsection (k) of this section prior to power ascension testing-and issuance of the Certificate of Operation.

(e)

The inservice inspection plan shall be submitted to the chief inspector by the owner or user prior to commercial service.

(f)

The chief inspector shall review the inservice in-spection plan and select those items necessary to verify com-pliance with the Texas Boiler Law (Texas Civil Statutes, Article 5221C) and ASME Code Section XI.

Items selected for verification shall be from within the verification boundary of the nuclear

boiler consisting of the components and component supports of the systems illustrated in Exhibit 4 (herein adopted by reference and which exhibit may be secured from the Texas Department of Labor and Standards, Boiler Division, 920 Colorado Street, Austin, Texas 78701, or mailing address P.O. Box 12157, Austin, Texas 78711).

(g)

The chief inspector shall, upon reasonable notification by the owner or user of inservice inspection activi-ties to be accomplished during any outage on items selected in

Texas Department of Labor and Standards Pase 5 of 6 Boiler Division Chapter 65 subsection (f) of this section, coordinate with the owner or user the verification activities.

(h)

The chief inspector shall review and maintain sum-mary reports of the inservice inspections that are submitted by the owner or user in accordance with ASME Code Section XI.

(i)

Repairs and/or replacements shall conform to the requirements of ASME Code Section XI.

(j)

The owner or user shall, in case of serious acci-dents to a nuclear boiler involving a breach of the pressure boundary integrity of components included in Exhibit 4, immedi-ately notify the chier inspector by the most expeditious means available and apprise him of the nature of the accident.

The chief inspector shall assess the nature of the accident, formu-latefinspection activities as required, and coordinate these ac-tivities with the owner or user and as necessary with other state and federal agencies having jurisdiction.

(k) -If exceptions or situations arise which are not specifically addressed in this section or other sections of the Boiler Law and Rules and Regulations, or in ASME Code Section XI, the owner or user shall contact the chief inspector for guidance or interpretation.
