I NRC STAFF MOTION FOR EXTENSION OF TIME 1.

THE MOTION The NRC staff (Staff) hereby requests an extension of time until January 29, 1988, to provide answers to the questions of the Administra-tive Judge forwarded to the Staff on November 24, 1987, 11.

DISCUSSION By Memorandum and Order (Order) dated November 24, 1987, the Administrative Judge forwarded ten pages of questions to be answered in writing by the Staff and Mr. Morabito by December 21, 1987.

The Order indicated the written answers would form part of the " direct testimony" for an oral presentation to be scheduled sometime in January 1988.

Order at 2-3.

The Order also indicated that the Staff could submit its response to Mr. Morabito's November 7, 1987 rebuttal by December 21, 1987, in answer to the Staff's " Motion for Opportunity to Respond to Rebuttal Filed by Mr. Morabito," dated November 19, 1987.

o e requires the Staff to file both (1) its response to Mr. Morabito's rebuttal and (2) answers to the questions attached to the Order by December 21.

The Staff will require additional time to prepare written answers to the Administrative Judge's questions since the Staff members who must prepare the answers are presently-engaged in writing a response to Mr. Morabito's rebuttal.

In addition, one Staff member is also preparing the Staff response to a specification of claims in another. reactor operator proceeding. O The ten pages of questions forwarded by the Administrative Judge consist of approximately sixty-three questions, some of which will require travel to the Beaver Valley plant to locate plant procedures.

The time necessary to prepare answers to the questions is significant.

Consequently, the Staff examiners who. must prepare the written answers to the Administrative Judge's questiot.s cannot complete the present work assigned in two proceedings as well as completing the written answers by December 21, 1907.

Therefore, the Staff requests an extension of time to allow preparation.of the answers to the Administrative Judge's questions.

Mr. Barry Norris was the supervising examiner for Mr. Morabito's examination and the examiner for Mr. David W. Heid's examination at the Beaver Valley Nuclear Plant in July 1986.

Mr. Held has also requested a hearing to contest the denial of his SRO !! cense for Bea-ver Valley, Unit 1.

Mr. Norris is responsible for co-authoring the responses in the Morabito proceeding and for sole authorship of the Staff responses in the Held proceeding.

Mr. Norris is presently preparing (a) a re-sponse to Mr. Heid's specification of claims, due December 11, 1987, (b) the Staff response to Mr. Morabito's November 7, 1987 rebuttal

due by' December 21, 1987, and will be responsible for co-authoring (c) the Staff responses to the Administrative Judge's questions.

CONCLUSION The Staff should be provided an extension of time until January 29, 1988, to submit written answers to the Administrative Judge's questions.
