This action was based on a violation involving a failure to perform a propffi safety evaluation in accordance with 10 CFR 50.59 for modification performe3 on the Auxiliary Feedwater System.

The licensee responded to the Notice in a letter dated April 10, 1987. After careful consideration of the licensee's response, the staff has concluded that the violation did occur as set forth in the Notice of Violation and Proposed Imposition of Civil Penalty and sufficient basis for reduction of the proposed severity level or remission of the civil penalty was not provided in the response.

Accordingly, an Order Imposing Civil Penalty in the amount of $50,000 has been issued today. Under the terms of the Order, the licensee may within 30 days of the date of the Order, pay the civil penalty or request a hearing.
