MEMORANDUM AND ORDER (Extension of Time)

On August 17, 1987, the NRC Staff filed a motion for an extension of time until October 9,1987 to respond to the " Specification of Claims" filed by Mr. Alfred J. Morabito on July 31, 1987. The Staff's response would otherwise be due to be filed on August 20, 1987. The Staff referred to the many "new arguments and/or new evidence concerning the examination answers" contained in Mr. Morabito's statement, and its need to obtain pertinent documentation in order to respond adequately.

The Staff advised that it attempted to contact Mr. Morabito concerning the extension of time but could not reach him since he was on vacation. On August 18 and 19, 1987, I also attempted to contact Mr.

Morabito by telephone but was unable to reach him.

Given the complexity of Mr. Morabito's " Specification of Claims,"

and the importance of adequately prepared responses, the Staff's request 8801040226 870819 SECY LIC55 05560755 Q,'
