NRC STAFF MOTION FOR EXTENSION OF TIME I.
THE MOTION For the reasons which follow, the NRC staff (Staff) respectfully asks for an extension of time until October 9, 1987 to respond to the
" Specification of Claims" filed by Mr. Morabito on July 31, 1987.
II.
DISCUSSION By Memorandum and Order dated July 15, 1987 the Presiding Officer in this proceeding requested that by August 5, 1987 Mr. Morabito particularize his_ claims of error in the Staff's denial of his application for.
senior reactor operator license.
The Memorandum and Order indicated
__that the Staff response to the particularization of claims should be filed within 15 days of service of Mr. Morabito's statement. Since Mr. Morabito filed his specification of claims on July 31, 1987 the Staff's response is due on August 20, 1987.
10 - C. F. R. 9 2.710.
The Staff who will be reviewing Mr. Morabito's claims and supplying the affidavit to respond to the claims finds the August 20 date impossible to meet.
Specifically, many issues in Mr. Morabito's specification 8801040212 870817 g6 SECYLIC550556g5
.r constitute new arguments and/or new evidence concerning the examination answers.
Because of
- this, the Staff has to obtain pertinent -
documentation concerning plant procedures, practices and design from the facility licensee in order to adequately respond to the claims.
For this reason, the Staff requests an extension of time until October 9, 1987.
This extension should provide enough time to obtain the necessary documents to review them, and to prepare a response.
Staff counsel could not discuss the motion with Mr. Morabito since he is on vacation.
111.
CONCLUSION For the reason stated, an extension of time should be granted until October 9,1987 for the Staff to respond to Mr. Morabito's specification of claims.
Respectfully sutmitted, flag /
