1 In its sutraits its Response to the above described Motion to Ccrapel.

Motion to Compel, CASE raises certain general objections to the response of TMPA to CASE's Interrogatories and Request for Production of Documents (6/19/87), as well as a specific concern regarding the response of SMPA indicating that a number of documents produced to the three Ccrnanche Peak minority owners by Texas Utilities Electric Ccrnpany ("TU Electric") in the Texas state court litigation should, in the judgment of UMPA, be produced to CASE in the licensing proceedings. 'IMPA will address those general objections and the specific concerns in this Response.

Pursuant to agreenent between counsel for Brazos, Tex-La and SMPA and counsel for Consolidated Interveners Citizens Association for Sound Energy

(" CASE") and Meddie Gregory (hereafter referred to only as " CASE"), the time for the minority owner / Applicants responses to CASE's motion was extended pending resolution of Brazos' Motion for Declaratory Order, and was subsequently extended by agreement of the parties.

CASE has sutaitted a number of detailed interrogatories which request information and documents of which MA is aware concerning the design and construction of Cmanche Peak.

W A's knowledge of the design.and construction of Cmanche. Peak is based alnest exclusively upon the Project documents in the custody of TU Electric, TU Electric's responses to discovery requests in the various NRC proceedings, TU Electric's reports to the NRC, its Staff and its Boards made pursuant to its ('IU Electric's) independent recorting obligation, information produced to the minority owners pursuant to discovery in the Texas state court litigation, and reports prepared by the NRO.

Responsive documents not already part of the record in the operating license proceedings or construction permit proceedings should be provided to CASE by TU Electric, which has sole responsibility and contro) over the design, construction and licensing of the plant under the parties' Joint ownership Agreement ("JOA").2_

As to information disclosed during depositions

-conducted in the Texas state court litigation which is responsive to CASE's interrogatories, TU Electric is in possession of full sets of deposition transcripts, exhibits thereto and drents produced pursuant to subpoena duces tecum at deposition by TU Electric and third-party organizations, and these may also be obtained frm TU Electric.

CASE has also propounded interrogatories requesting information on criticisms of the Unit 1 QA/QC program of which WA is aware. M A, Brazos and Tex-La have experts working on reports due to be turned over to TU 2

TU Electric has computerized both the Project documents and the dev'=nts that have been exchanged during discovery by the parties to the Texas state court litigation, and therefore can generate indices to facilitate CASE's review of the documents responsive to its requests. _ _ - - - _ - - _ _ _

Electric in the Texas state court litigation on February 1, 1988, as required by an Order entered by Judge John Marshall in that litigation.

'INPA will turn these reports over to CASE at the same time they are turned over to TU Electric pursuant to that Order.

TMPA has informed TU Electric that it believes certain Av-nts should be disclosed to the NRC and CASE in the licensing proceedings.

W Electric has asserted various privileges and exenptions frm discovery as to a category of documents into which the documents in question may fall.

The legal sufficiency and applicability of those privileges and exenptions frm discovery is currently before the trial court in the Tcxas state court litigation.

Contrary to this Board's order of May 4,1987, W Electric has failed to withdraw its threat against 'IMPA of retaliatory legal action if 'INPA discloses the disputed documents prior to resolution of its claims of privileges and exemptions frm discovery by 'IU, thereby preventing '1NPA frm fulfilling its NRC discovery obligations pending resolution of certain disputed issues in the Texas state court litigation.

As to such docunents, TU Electric should produce thm directly to the NRC and to CASE.
