As you may recall, on December 1,1980, Battelle established a Trust Fund to receive and hold certain payments from sponsors of research and development projects involving work with radioactive materials at the nuclear research facili-ties in West Jefferson, Ohio. The Trust Fund was created to provide, at some time in the future, funding for the ultimate decontamination and decommissioning of Battelle's facilities.
The Trust Agreement provides that Bank One Trust, the designated Trustee, shall make disbursements from the Trust Fund only for expenses associated
. ilth decontamination and decommissioning which are in accoMance with a decommissioning plan approved by the NRC. Also, Battelle must certify that such disbursements are in accoMance with the approved plan. AccoMing to the Trust Agreement, Battelle is required to provide to the Trustee copies of the decommissioning plan and NRC's approval of such plan. Because we are proceeding to initiate specific decommissioning and decontamination actions, it will be necessary to begin accessing the Trust Fund.
Bank One Trust would like to have a current letter from NRC noting approval of the decommissioning plan referred to in the Trust Agreement. In your letter to Mr. Harley L. Toy, dated June 29,1979, you stated that the " conceptual decommissioning plan with its cost estimate...is acceptable." Pursuant to discus-sions that we had at a joint meeting, on July 23,1987, with DOE, Chicago Opera-tions Office, NRC Region III, and Mr. Peter Loysen, of your office, and based on my discussions with Mr. Loysen, on July 20,1987, we are asking you to send us a letter reconfirming your approval of the decomn;issioning plan. We will then forwaM a copy of such letter to the Bank One Trust Company.
