Dear Senator Byrd:
L I have been requ.ested to respond to your letter of July 31, 1987, to 2
Mr. Carlton C. Kammerer, Director for State, Local and Indian Tribe Programs, in which you requested a report on the licensing of the Seabrook Nuclear Station.
Currently, Public Service Company of New Hampshire (PSNH) has a license to load fuel in Seabrook Nuclear Station, Unit 1, and to run precritical tests. PSNH seeks to obtain a full-power operating license. The first step is to obtain a license that will permit PSNH to operate the nuclear plant up to.5-percent-power and to perform certain startup tests. The second step is to obtain a full-power operating license that will permit PSNH to commercially operate the nuclear plant to generate power. The latter step is what Mr. Gates, your constituent, hopes will be achieved without delay.
To obtain a 5-percent-power license, PSNH is required to submit to the Comission a bona fide utility emergency preparedness plan that covers the Massachusetts portion of the Seabrook plant's emergency plancing zone (EPZ). PSNH has indicated it will submit such a plan in mid-September 1987. The Commission will consider the plan along with any coments the Commission may receive from parties to the Seabrook proceedings.
If the Commission renders a decision favorable to PSNH, the Commission could authorize the issuance of a 5-percent power license.
To authorize issuat.w of a fd-power license, a number of matters have to be completed. One matter is that hearings on the New Hampshire emergency preparedness plans for the Seabrnnk cite must be held by the Atomic Safety and Licensing Board (ASLB). FThe hearings on the New Hampshire emergency plan are scheduled to commence on September 28, 1987 and will probably take a number of months to complete. Another matter is that the utility's emergency plan for Massachusetts must be reviewed by the Federal Emergency Management Agency and the NRC, and may also be the subject of litigation before the ASLB. Such review and litigation must be completed with findings favorable to PSNH prior to issuance of a full-power license.
