ORDER Oral argument on the appeal of Charles Husted from the April 2, 1987 initial decision of the Administrative Law Judge will be heard at 10:00 a.m. on Wednesday, September 9, 1987 in the NRC Public Hearing Room, Fifth Floor, East-West Towers Building, 4350 East-West Highway, Bethesda, Maryland.

Each side will be permitted forty-five minutes for the presentation of its argument. Counsel for Mr. Husted and the two other parties supporting his appeal (GPU Nuclear Corporation and the NRC staff) should agree among themselves in advance of argument on the division of the time on their side of the case.1 l

1 Three Mile Island Alert is the single party in opposition to the appeal.

In preparing for argument, the participants may assume that the members of this Board will be generally familiar  ;

-l with the decision of the Administrative Law Judge and the appellate positions'of thel parties as bet forth in their t-briefs. There thus~will be no necessity for any participant to commence his or her argument with a recitation.of the background of the controversy. ,

Each party shall provide the Secretary to this Board, by letter mailed no later than September 2, 1987, with the name of the person who will present oral argument on his or, its' behalf.. Counsel for Mr. Husted shall include in his letter a statement respecting the agreed-upon division of the time allotted to his side.
