Negative Findings: State and local Plannirg and Preparedness for the Lacrosse Boiling Water Reactor.
This is to transmit negative findirgs prepared by Federal Emergency Management Agency (FD1A) Regions V and VII for State and local offsite emergency planning and preparedness for the LaCrmse Boiling Water Reactor (LACBWR) located in Vernon County, near the Town of Genoa, Wisconsin. These negative findings affect the States of Wisconsin, Minnesota and Iowa. The States are impacted by the IACBWR plume exposure 5-inile Emergency Planning Zone (EPZ).
Recently, FEMA has requested clarification fran the Nuclear Regulatory Ccmmission (NRC) on the status of offsite radiological emergency preparedness requirements at LACBWR, since the plant was permanently shut down as of April 30, 1987.
The July 24, 1987 memorandum from Frank Congel to Richard W. Krimm outlined the present plant configuration and indicated that NRC is deferring emergency preparedness actions until the decommissioning plan is submitted. However, as we indicated in my August 7, 1987, memorandum to you, the issue of when FDIA can suspend offsite emergency preparedness activities was not addressed.
In the absence of such guidance, FEMA must continue to abide by the existing regulations. Therefore, as explained in the attached memoranda, FEMA cannot continue to find that there is reasonable assurance that offsite preparedness is adequate to protect the public health and safety in the Iowa, Wisconsin and Minnesota portions of the IACBWR EPZ.
The State of Iowa will be notified immediately of this negative finding. As shown in the attached recoranda, the State has been informed over the past few months of the problems underlying FEMA's negative evaluation.
In addition, on April 3, 1987, the State was informed that they had until October 1, 1987 to submit an offsite preparedness plan under the provisions of 44 CFR 350 for the portion of the Lacrosse EPZ within its jurisdiction.
If such a plan is not submitted by that date, its absence will form an additional basis for the negative finding.
The State and local radiological emergency preparedness plans for Wisconsin and Minnesota, site-specific to LACBUR, were approved under 44 CFR 350 on May 10, 1985, and August 13, 1985, respectively. Under the regulations, due to the negative findings FEMA must apply the provisions of 44 CFR 350.13, by which the approvals could be revoked unless certain conditions are mot.

. notified through the Director of FEMA Region V of the reasons for FEMA's application of 44 CFR 350.13. Since Iowa does not have FEMA approval of the offsite plans for its portion of the IACBWR EPZ, no action under 44 CFR 350.13 is required for Iowa.
The attached memorandum frcm FEMA Region V spells out in detail the basis for i
the determination of the deficiencies in the plans and preparedness of the States of Wisconsin and Minnesota.
If, after 4 months from the date of the notification to the Governors, the States have not: (1) Corrected the deficiencies noted, or (2) submitted an acceptable plan for correcting those deficiencies, then the Associate Director of State and local Programs and Support is to withdraw approval. At that time, NRC and the Governors of the affected States would be informed immediately of the determination to withdraw approval.
A notice of the withdrawal of approval would also be published in the Federal Register and the local newspaper having the largest circulation in the affected States.
Durity the 4-ronth period provided in the regulations, we will pursue correction of these deficiencies with the States. However, as we noted above, in July 1987 NRC irdicated that IACBWR was permanently shut down on April 30, 1987 and that the licensee was expected to submit an emergency plan in the next three nonths, i.e., by the end of October 1987. We encourage NRC to review the energency plan as soon as possible and advise us when offsite energency l
planning considerations are no longer warranted throughout the entire plume and ingestion exposure emergency planning zones at IACBWR. Since the regulations allow only 4 months for actions to prevent the withdrawal of the formal plan approvals for Wisconsin and Minnesota, we would appreciate such information as soon as it beccties available, due to its critical impact on activities proceeding under 44 CFR 350.13.

we also attach a copy of the FEMA Region V report of the December 2,1986, l
joint exercise of Wisconsin and Minnesota State and local plans that was noted in Region V's negative finding. In the December 2,1986, exercise, there was one d3ficiency in that the initial instructional message for the public was delayed in preparation by the Vernon County Emergency Operating j
Center and it was not broadcast within 15 mirutes.
