Dear Mr. Stello:

On July 16, 1986, the Nuclear Regulatory Conunission (NRC) requested the Federal Emergency Fbnagement Agency (FDM) to review Revision 7 of the Lorg Island Lighting Company's (LITO) Transition Plan for the Shoreham Nuclear Power Station (SNPS) and LITO's responses to the FDM Region II Shoreham Post Exercise Assessment (PEA) for the February 13, 1986 exercise of Revision 6 of the LITO Transition Plan. On September 30, 1986, NRC requested FDM to include Revision 8 in its review of the LILCO Plan. The requests were node under the NRC/FDM Memorardum of Understanding (MOU). 7, A full Regional Assistance Ccmnittee (RAC) review of Revisions 6, 7 and 8 ' Q) ' / has been conpleted ard the results are contained in the enclosed report entitled "LITO Transition Plan for Shoreham - Revision 8, Consolidated RAC Review" dated Decenber 15, 1986. The LILCO responses to the FDM PEA are evaluated separately on the enclosed spread sheets. (Note: On February 12, 1986, FDM provided NRC with the results of the FDM review of Revision 6; i however, due to the limited nature of the changes, the review was conducted by FDM Ibgion II. In reviewing Pevisions 7 and 8, FDM also requested ' the RAC to include Revision 6 in their review). The RAC reviewed the plan revisions against the stardards ard evaluative l criteria of NUREG-0654/FDM-REP-1, Fev.1. Based on FD%'s evaluation, l Pevision 8 contains fifteen inadequacies. The planning inadequacies and reconnendations for improvement are explained in the enclosed RAC review. Due to the legal authority issues which arise when some NUREG elemnts are ~ d applied to a utility-based plan, we have narked with an asterisk any aspect i of the plan where, in our view, this legal issue occurs. 17he specific 0 l legal concern related to that part of the plan is identified separately in f.: ' of the consolidated RAC review of Pevision 5. ~ 1 l . 2-The issue of the participation of WALK FM radio was treated in the following manner. Via the September 18, 1986 LILCO letter transmitting Revision 8 to NRC, it came to FEMA's attention that on September 16, 1986, WALK FM had j. withdrawn fran its agreement to serve as the Shoreham emergency broadcast prinary station. In that letter, LILCO also stated that a replacement station would be incorporated in the next plan revision. Based on the fact that the administrative processes for printing and delivering Revision 8 (which includes WALK FM radio) had undoubtedly been completed by the time that LILCO was informed of WALK's withdrawal, FEMA evaluated element E.5, which depends on j the participation of that particular radio station, as adequate. However, l in any future reviews of the plan, element E.5 (and perhaps others) would be j rated inadequate unless a suitable substitute station has been utablished i and is supported with the necessary letter (s) of agreement. t In the spread sheets detailing the FEMA evaluation of LILOO's responses i I to the FEMA Post-Exercise Assessment, there are several instances where training was to have occurred by September 1, 1986. FEMA did not request rosters or take other steps to verify that such training took place. As stated in the evaluation portion of the spread sheets, the training's effectiveness would have to be evaluated in the future. 1 As you are aware, FEMA and the RAC have consistently supported the NRC in the i l( Shoreham licensing process by reviewing numerous LILCD Transition Plan iterations sutnitted to us for review under the provisions of the MOU. l FEMA has expended a considerable artount of staff time and financial resources to provide for these reviews and subsequent expert witness testinony before various NRC l I licensing boards related to plan litigation. Further, at NRC's request, l FEMA devoted additional resources to the preparation for and evaluation of I the exercise of the LILCO plan. At present, there are a number of unresolved issues being considered or litigated in no less than three different NRC forums. There are planning and exercise issues l before two licensing boards; numrous issues under consideration by the full i In addition, the OL-3 Board has recently reopened the record on ) Connission. issues related to the Nassau Coliseum. i (A separate letter on these issues is being sent from FEMA's General Counsel to the NRC General Counsel.) In FEMA's view, the fluidity of this great number of issues renders it impractical, and an unwise use of limited resources, to continue to perform further reviews of LILCD plans or exercises under the current unsynchronized l manner in which these issues are being adjudicated. This works to the detriment of effective treatment of the issues from a progrannatic view- , point. Within the limits of sound management of resources, FEMA remains caninitted to providing testirony to assist in the resolution of the various issues before the NRC's licensing boards and to provide information which may be needed by the Conmission to resolve issues being considered by them. b

American Red Cross - The letter dated August 21, 1986 submitted with Revisidn 8 of the plan states that " there is no agrecuent between Long Island 2 Lighting Company and this (Nassau County) Chapter relating to the chapter's responsibility to provide emergency assistance during a radiological emergency." This letter is not an acceptable letter of agreement to assure that American Red Cross responsibilities for Congregate Care facilities 4 described in the plan will be carried out. Teledyne Isotopes - The new purchase agreement with Teledyne Isotopes, Appendix B, B-74A to 74D is an agreement for the routine Radiological Environmental Monitoring program. There is some mention of 24 hour emergency analysis; however, this reference is in regard to routine samples being over prescribed limits. This element is rated inadequate until the plan is revised to accomplish timely distnbution of dosimetry to the large number of Bus Drivers required to be dispatched from the Patchogue Staging Area. This inadequate rating also affects element J.10.g of this review. Procedures for field workers, i.e., bus drivers, traffic guides, etc., have been 5 modified to include instructions to make prompt notifications through their communication network of any potential Impediment. Incoming vehicles will be directed to monitoring stations where the vehicle and driver will be checked for a contamination. According to this screening procedure, passengeru of the vehicle will also be assumed to be uncontaminated and a clean tag will be issued to them if the driver is below contamina-tion limits This screening procedure is inadequate since the applicable guidance requires the capability of monitoring within about a 12 hour period all residents and transients in the plume EPZ arriving at tiie Reception Centers. LERO is responsible for monitoring all evacuees arriving at reception centers, it is not adequate.to plan for this monitoring with personnel and equipment when available. It is not possible to evaluate the number of personnel required for monitoring at the special population reception centers since the plan shows in procedure OPIP 3.6.5 pages 21-37, "to be arranged" for most of the special population reception centers.
