OFFICE 0? n m " Before the Atomic Safety and Lice NfE1 A5k8aYb In the Matter of ) ) TEXAS UTILITIES ELECTRIC COMPANY, ) Docket No. 50-445-CPA et al., ) ) (Comanche Peak Steam Electric ) Station Unit 1) ) RESPONSE OF BRAZOS ELECTRIC POWER COOPERATIVE, INC., TO CONSOLIDATED INTERVENERS' MOTION TO COMPEL APPLICANTS TO SUPPLY c COMPLETE ANSWERS (9/15/87) Applicant Brazos Electric Power Cooperative, Inc. ,'Brazos"), hereby respectfully submits its Response to the above described Motion to compel. 1/ In its Motion to compel, CASE raises certain general objections to the response of Brazos to CASE's Interrogatories and Request for Production of Documents (6/19/87), as well as a specific concern regarding the response of Brazos indicating that a number of documents produced to the three Comanche Peak minority owners by Texas Utilities Electric Company ("TU Electric") in the Texas state court litigation should, in the judgment of Brazos, be produced to CASE in the i 1/ Pursuant to agreement between counsel for Brazos, Tex-La and i TMPA and counsel for Consolidated Interveners Citizens Association for Sound Energy (" CASE") and Meddie Gregory (hereafter referred to only as " CASE"), the time for the minority 1 owner / Applicants response to CASE's motion was extended pending resolution of Brazos' Motion for Declaratory Order, and was subsequently extended by agreement of the parties. Brazos will address those general 1 I objections and specific concerns in this Response. l l CASE has submitted a number of detailed interrogatories which request information and documents of which Brazos is aware concerning the design and construction of Comanche Peak. Brazos' knowledge of the design and construction of Comanche Peak is based almost exclusively upon Project documents controlled by TU Electric, TU Electric's responses to discovery requests in the various NRC proceedings, TU Electric's independent reporting obligations to the NRC, its Staff and its Boards, and o'n information produced to the minority owners pursuant to discovery in the Texas state court litigation. Responsive documents not already part of the record in the operating license proceedings or construction permit proceedings should be provided to CASE by 1 TU Electric, which has sole responsibility and control over the design, construction and licensing of the plant under the parties' Joint ownership Agreement ("JOA"). 2/ As to information disclosed during depositions conducted in the Tex &n state court litigation which is responsive to CASE's interrogatories, TU Electric is in possession of full sets of deposition transcripts, exhibits thereto and documents produced pursuant to subpoena duces tecum at deposition by TU Electric and third-party 2/ TU Electric has computerized both the Project documents and the documents which have been exchanged during discovery by the parties in the Texas state court litigation, and therefore can generate indices to facilitate CASE's review of the documents responsive to its requests.

CASE has also produced interrogatories requesting information on criticisms of the Unit 1 QA/QC program of which Brazos is aware. Brazos, Tex-La and TMPA have experts working on reports due to be turned over to TU Electric in the Texas state court litigation on February 1, 1988. Brazos shall turn these reports over to CASE at the same time they are turned over to TU O Electric. Brazos has fhformed TU Electric that it believes certain documents should be disclosed to CASE and the NRC in the licensing proceedings. TU Electric has asserted various privileges as to a category of documents into which the documents in question may fall, and the legal sufficiency and applicability of those privileges is currently before the trial court in the Texas state ccur'c litigation. Contrary to this Board's order of May 4, 1987, 'IU Electric has failed to withdraw its threat against Brazos of retaliatory legal action if Brazos discloses i the disputed documents prior to resolution of its claims of privilege and exemption from discovery, thereby preventing
G l I.Brazos from fulfilling its NRC discovery obligations pending resolution of certain disputed discovery issues in the Texas state courts.
