ORDER IMPOSING CIVIL MONETARY PENALTY - $2,750 By EN 98-015 dated March 20,1998, the Commission was notified of the intent of OE to issue a Notice of Violation and Proposed Imposition of Civil Penalty in the amount of $5,500 to Ground Engineering and Testing Service, Inc. This action was based on a Severity Level lil violation involving a willful faMure of this Agreement State licensee to file for reciprocity before conducting licensed activities in areas under NRC jurisdiction.
The licensee responded to the Notice in two letters dated April 22 and 23,1998, in its responses, the licensee admitted the violation, but denied that the violation was the result of willfulness and requested that the civil penalty be mitigated based upon its prompt corrective action. After careful consideration of the licensee's responses, the staff has concluded that the licensee did not provide an adequate basis to conclude that the violation was not committed willfully. However, the staff has concluded that, based upon the new information submitted by the licensee, credit is warranted for the licensee's prompt corrective action and, thus, in accordance with the Enforcement Policy, the proposed civil penalty of $5,500 should be mitigated by $2,750.
Accordingly, an Order imposing Civil Monetary Penalty in the amount of $2,750 is being issued today. Under the terms of the Order, the licensee may, within 30 days of the date of the Order, pay the civil penalty or request a hearing.
