ISSUES NECNP MOTION FOR LEAVE TO FILE RESPONSE TO NRC STAFF MEMORANDUM NECNP hereby moves the Appeal Board for permission to file a response to "NRC Response to Memorandum of Licensing Board and New England Coalition on Nuclear Pollution Regarding Environmen-tal Qualification of RG-58 Coaxial Cable," December 11, 1987.

The staff presents therein the affidavit of an asserted expert who appears to suggest yet another rationale different f rom the Licensing Board's for finding RG-58 qualified, on the basis of his judgment concerning a variety of factors "collec-tively."

This affidavit was, of course, not a part of the adjudicatory record nor was the basis'of his opinion or his expertise subject to the cross-examination of NECNP.

The Appeal Board should note, more-over, that the affiant essentially concedes that NECNP was cor-rect in pointing out that the Licensing Board's rationale for finding RG-58 qualified, namely its assumption that propor-tionality ensures " similarity" within the meaning of 10 C.F.R.

S 50.49, is not correct.
