Docket No. 50-320-OLA (Disposal of Accident-Generated. Water)
Administrative Judges Wolfe, Bright, and Paris:
On December 8, 1987, a special prehearing conference was held principally to address the admissibility of contentions pro-posed by Susquehanna Valley Alliance and Three Mile Island Alert 8712290051 871216 3

A PARTNCR$pHP (NCLUQiNG PROFESSIONAL CORPORATIONS Administrative Judge Sheldon J. Wolfe Administrative Judge Glenn O.
Bright Administrative Judge Oscar H. Paris December 16, 1987 Page 2 (collectively " Petitioners").
During oral argument on the admis-sibility of proposed Contention 1, Petitioners cited York Commit-tee for a Safe Environment.v. United States Nuc. lear Regulatory Commission, 527 F.2d 812 (D.C. Cir. 1975), apparently for the proposition that the ALARA numerical guidelines contained in Appendix I to 10 C.F.R. Part 50 are invalid.
Now that counsel has had the opportunity to read that decision, we take this op-portunity to state Licensee's position that Petitioners' reliance on York Committee is misplaced.
The Commission concluded the Appendix I rulemaking proceed-ing in 1975.
See In ge Rulemaking. Hear.ing, Numerical Guides for Design Objectives and Limiting Conditions for Operation to Meet the Criterion "As Low As Practicable" for Radioactive Material in Light-Water-Cooled Nuclear Power Reactor Effluents, CLI-75-5, 1 N.R.C. 277, 278 (1975).1/
In the intervening tweleve years, the Commission has consistently held that observance of Appendix I's numerical guides "shall be deemed a conclusive showing of compliance with" the ALARA requirements of Part 50.
Northern. States Power Co. (Prairie Island Nuclear Generating Plant, Units 1 and 2), ALAB-455, 7 N.R.C.
41, 58 (1978);
Licensee's Response to Supplement to Petition for Leave to Inter-vene By TMIA and SVA at 12 (November 12, 1987); see also..In re Rulemaking Hearing, supra, CLI-75-5, 1 N.R.C. at 278, 333 (1975);
Public. Service Company.of. Oklahoma (Black Fox Station, Units 1 and 2), CLI-80-31, 12 N.R.C.
264, 267-268 (1980).
Therefore, Pe-titioners' reliance on York. Committee is misplaced and proposed Contention 1 still lacks a basis with specificity.
Respectfully submitted, A-A /%u Maurice A. Ross Counsel for Licensee cc:
Service List (attached)

In its decision, the Commission reported that in the future it intended to substitute "as low as is reasonably achievable" (ALARA) for "as low as practicable" (ALAP).
The Commission noted that this change in terminology would not affect the numerical values established in Appendix I to 10 C.F.R. Part 50.
In re Rulemaking Hearing, supra, CLI-75-5, 1 N.R.C.
at 278 (1975).
