l am responding to your e-mail of July 30,1998, to Chairman' Jackson. We have received your I letter of June 4,1998, regarding the progress of the proposed Agreement between the l
Commission and the State of Ohio. Because we had not yet received a formal application from I Ohio for an Agreement, and your letter did not request a specific response, we have treated i your letter as an early public comment on the proposed Agreement. Your letter will be l addressed along with other comments we may receive in response to the publication of the
- proposed Agreement in the Federal Reaister.
On January 26,1998, we received a draft of the request for an Agreement, and on July 31, l 1998, we received a formal request from Governor Voinovich. In accordance with our l
procedures, we will review the proposed Agreement against the criteria established in Section ;
274 of the Atomic Energy Act of 1954, as amended, and in the Commission policy statement
" Criteria for Guidance of States and NRC in Discontinuance of NRC Reaulatory Authority and Assumotion Thereof by States Throuah Aareement." The policy statement was published in the Federal Reaister January 23,1981 (46 FR 7540-7546); a correction was published July 16, ,
1981 (46 FR 36969); and a revision of Criterion 9 was published in the Federal Reaister July 21,1983 (48 FR 33376).
Based on review of the draft request, we have identified concerns similar to those expressed in your letter. Before the proposed Agreement can be completed, the Ohio Bureau of Radiation Protection must demonstrate that an adequate number of individuals, with sufficient training and experience to successfully implement the program, will be on staff at the time the Agreement becomes effective.
The Bureau has prepared a response to these and other comments by the NRC staff on the draft request. The response will be reviewed against the critoria described above. NRC staff l will not recommend Commission approval of the proposed Agreement until the review criteria
- have been satisfied, and the staff is confident that the Ohio program will be adequate to protect k l public health and safety and will be compatible with the materials program of the Commission.
Upon bommission approval, the proposed Agreement, along with a summary of the staff
( assessment of the Ohio program will be published in the Federal Reaister. once a week for four consecutive weeks, as required by the Atomic Energy Act. The full text of the staff assessment will be available in the NRC Public Document Room for public review and comment. We will welcome your further contributions to the review process.
