NOTICE OF VIOLATION

Dear Mr. England:

This refers to the telephone conversation of May 11,1998, notifying our office of the loss of two krypton-85 Basis Weight Mass Sensor gauges. The gauges (Measurex, Inc., Model 2201, Serial Nos. KR1553 and 50278K) contained 1000 millicuries of krypton-85. On, or about, May 6, 1998, Fletcher personnel discovered that the krypton-85 thickness gauges were not properly disposed of or transferred from the Waterviliet, Michigan, plant prior to transferring the plant to i rnu owners. Two thickness gauges were found in a facility in Fitchburg, Massachusetts. With the assistance of Measurex, Inc., as of June 18,1998, you have properly transferred the generally licensed materials to an authorized recipient.

After reviewing this incident, the NRC has determined that a violation of NRC requirements occurred. The violation concemed Fletcher Paper Company's unauthorized trailsfer of an NRC Denerally licensed device and is cited in the enclosed Notice of Violation. Because you no ionger own the facility, you took prompt actions to have the gauges transported to the original manufacturer, and you took action to ensure all gauges used at the Waterviliet facility were accounted for no written response to this letter is required, and we have no further questions regarding this matter.

The vLlation demonstrates the importance of maintaining adequate control of all radioactive material to ensure that improper handling or disposal does not occur. We caution you that any similar violations in the future may result in additional enforcement action, including the imposition of monetary penalties (fines) and orders suspending, revoking or modifying your authorization to possess and use generally licensed devices.

In accordance with 10 CFR 2.790 of the NRC's " Rules of Practice," a copy of this letter and the enclosure will be placed in the NRC Public Document Room.
