APPLICATION FOR SPECFIC LICENSE TO IMPORT RADIOACTIVE WASTE (NRC ASSIGNED LICENSE NUMBER IWOO5)

Dear Mr. Still:

Thank you for your April 16 response to our request for additional information regarding the subject import license application. The response, however, did not fully answer our concerns regarding final disposition of the waste and gave no indication that a State / compact is willing to accept the waste. In order for us to proceed with the review of your application we would <

appreciate receiving information to resolve the following points: 1

1. Your response states that the total curies of the shipment is 3.77 millicuries . Several other applications for the same lot of material have stated that the activity is 36 millicuries. Please confirm which value is correct. ,
2. Section 110.32(f)(5) states that the ultimate disposition of the waste, including formt of management, should be described. In our request for additional information, we were particularly interested in additional details on use of contaminated materials for " shield blocks' or melting into ingots "for reuse". Your response did not provide sufficient detail on this concern. You stated that the material that is recycled with radioactive I contamination can only be released to NRC or Agreement State licensees, or DOE. We are looking for more information to determine if in fact such an approach is feasible. U Which licensees would purchase such material? What assurance is there that DOE would purchase such material?

In addition, your response states that scrap metal would be released to a " Licensing Stats" which is distinguished fr.7m an Agreement State. Please define " Licensing State."

3. Your response does not adequately address our concern about any State and compact agreeing to the disposal of the residual waste. Instead, you simply stated that waste disposalis MSC's responsibility to manage and dispose r ?in accordance with Federal,
