Dear Dr. Paperiello:

The purpose of this letter is to provide a response to the NRC's request (TAC No. L32973) for additional information on the Certificate Amendment Request (CAR) dealing with the subject revisions to the Technical Safety Requirements. The request for additional information was provided to USEC in Reference 1 and identified additional information required by NRC to allow final action to be taken on the subject Certificate Amendment Request. Enclosure 1 to this letter provides USEC's response to the request for additional information.

Response to Request for Additional Information (TAC No. L32073)

CAAS Cluster Addition to TSR 2.6.4.1; CAAS Surveillance Frequency Revision for TSR 2.3.4.7; Cross Reference Revision for TSR 2.2.4.4 Ouestion The revision to TSR 2.6.4.1 involves adding a new criticality accident alarm system (CAAS) cluster to the TSR. The proposed cluster is cluster AC which covers operations in C-746-Q-1.

This cluster is currently under the control of the Department of Energy (DOE). It is our understanding that the area (and operations) covered by cluster AC is not leased by USEC and will remain under DOE control. Since the NRC does not have any legal authority to regulate DOE activities, we cannot approve a TSR that covers DOE operations. Please remove the changes to TSR 2.6.4.1 from the amendment request. Ifour understanding of the situation is incorrect, please submit documentation that indicates the area in C-746-Q-1 covered by cluster AC has been leased by USEC.

Response

AC cluster is physically located in C-746-Q, which is not a leased facility. Therefore, USEC hereby withdraws the revision to TSR 2.6.4.1 previously transmitted in USEC letter GDP 98-0039, which proposed to add the AC cluster to the C-746-Q-1 facility, from the Certificate Amendment Request.
