As documented in Reference (g) Maine Yankee met with the NRC staff on July 10,1998, to discuss g (j the Maine Yankee backfit appeal regarding the stafrs decision to rely on certain analysis and acceptance criteria associated with Generic Issue 82. During that meeting Maine Yankee discussed its claim that imposition of these new staff positions constitute a backfit (re: 10CFR50.109) with

. regard to our emergency preparedness exemption request (Reference (b)) and our financial protection g()\\

exemption. request (Reference (c))'. However, a review of our previously submitted written i

correspondence (References (d)and (f)) indicates that additional clarity is appropriate.

Maine Yankee requests that the staff consider both its emergency preparedness and financial j

- protection exemption requests during the backfit appeal process.
