Dear Mr. Gigliotti:

This responds to your 10 CFR 73.5 request of September 1, 1987 concerning the use of R-cleared guards in guard towers.

We have reviewed your request for an exemption from 10 CFR Part 11 and have determined that your request does not provide for adequate protection of the common defense and security and otherwise is not in the public interest. Your request for exemption is denied. 10 CFR Part 11 clearly states that security personnel must have appropriate security clearances. Even though the guard towers are just outside of the protected area, the guard towers are an integral part of your onsite physical security program. Their security function is not less than that of guard towers located inside of a protected area. Accordingly, the security clearance level should be the same for all guards in your security organization.

We understand your stated problem of obtaining clearances in a timely manner and we are in correspondence with DOE concerning your clearance problems. We have requested clearances for security personnel be expedited.

Your September 1 letter has been withheld from public disclosure because it contains classified (CONFIDENTIAL) National Security Information and must be controlled in accordance with the provisions of 10 CFR Part 95.
