STAFF REQUIREMENTS - SECY-98-084 - STATUS OF EFFORTS TO FINALIZE REGULATIONS FOR RADIOLOGICAL CRITER.lA FOR LICENSE TERMINATION: URANIUM RECOVERY FACILITIES This is to advise you that the Commission has not objected to the staffs recommendation to use Alternative 3 - the benchmark approach -in developing a final rule applicable to uranium recovery licensees. As proposed by the staff, the Commission should be consulted in cases where the calculated benchmark dose (before applying the ALARA principle) exceeds 100 millirem / year to a member of the public. The staff should codify this requirement in 10 CFR Part 40, Appendix A to make it clear that consultation with the Commission is required in such cases.

The staff should continue the dialogue with EPA and other agencies through the Interagency Steering Committee on Radiation Standards on how to use the various dose modeling codes available in a consistent manner. The Commission commends the author of the differing viewpoint included in the paper for his contribution to insuring that all options were considered and that the strengths and weaknesses of the dose modeling codes were made transparent.
The staff should consider the points made in the differing viewpoint and attempt to strengthen those aspects of the staffs proposed approach when developing the final rule.
