In its April 15,1998, letter to the staff, GTS Duratek states that is its applying for a j
license under 10 CFR 110.20, " General License Information." At the same time, the i
application provides all of the information for a specific license identified in 10 CFR
]
i 110.32. DWM has reviewed the application as if it were for a specific license. Although l
" incidental radioactive material" can be imported under a general license, the radioactive j
contamination described in the application does not appear to meet that definition, and l
thus a specific license appears to be required.

10 CFR 110.32(f)(5) states that for proposed imports of radioactive waste, the ultimate disposition (including forms of management) of the waste shall be described. The l
application does not describe in sufficient detail the ultimate disposition of the waste.
a) GTS Duratek states that radioactive contamination will be removed by chemical solutions and by abrasive methods, but does not state the disposition of the waste after it is removed. The application states that the decontamination solutior, will be reused, but does not address the disposition of the solution and the radioactive waste contained in it, nor does it address contamination removed by abrasive methods.
b) The application states that " secondary waste," such as gloves, booties, and tape, shall be co-mingled with waste from other sources and treated as GTS Duratek

generated waste and disposed of in accordance with existing procedures and j
applicable licenses and permits. The applicant should provide specific information on the ultimate disposition of the waste; i.e., the procedures that will apply, and the disposal facilities that will be used.

10 CFR 110.43(d) states that, for the import of radioactive waste, "an appropriate facility has agreed to accept the waste for management or disposal." This information should be provided, both for " secondary waste" as described above, for the waste discussed in 2.a), and for radioactive contamination in tubing that will be recycled into " shielding blocks."

Because the applicant has not fully addressed the requirements for ultimate disposition of the waste, it may be premature to consult with the States and compacts, since it is not clear which States and compacts may be affected by this import. Further, if Bamwell were to be proposed as a disposal facility for this waste, the State of South Carolina should also be consulted, in addition to the Southeast Compact.

110.32(f)7) requires that the need for shipments by the dates specified be described in the application. Although the date is specified (December 1998), the applicant did not address the need for a shipment on that date.

The license application states that decontaminated material meeting the surface contamination limits in Regulatory Guide 1.86 wi:1 be free released and sold as clean scrap metal. Additionalinformation should be provided on the measurement techniques for surveying decontaminated material. The minimum detectable e ctivitiy (or concentration) of the measurement method should be furnished, as well as a comparison with the MDA's of radiation detection equipment that is used to survey incoming material at an unlicensed commercial recycle facility.
