Dear Ms. Bauman:
This letter responds to your FOIA Appeal of April 13, 1987 (87-A-20C) of the partial denial of your initial FOIA request l (87-86).
In response to your appcal, this agency has re-reviewed the documents initially withheld. Accordingly, I have affirmed the agency's initial decision with regard to all documents except Document #6 of Appendix B which will be released as Appendix C and placed in the NRC's Public Document Room (PDR) under your name.
The documents withheld pursuant to Exemption 5 of the Freedom of Information Act (FOIA) are part of the commission's predecisional or deliberative processes. The purpose of the deliberative process privilege is to " prevent injury to the j quality of agency decisions." NLRB v. Sears, Roebuck & Co., j 421 U.S. 132, 151 (1975). Disclosure of these predecisional j documents would be likely to ' stifle honest and frank j communication within the agency." Coastal States Gas Corp. v. l Department of Energy, 617 F.2d 854, 866 (D.C. Cir. 1980).
The initia'l Appendix B did not correctly describe the documents withheld. I have attached a revised Appendix B.
This letter represents final agency action on your April 13, 1987 FOIA Appeal. Judicial review of the denial of documents is available in Federal District Court in the district in which you reside or have your principal place of business, or in the District of Columbia. i l
