IN RESPONSE REFER TO FOIA-98-186
Dear Mr. Del Core:
I am responding to your letter dated May 18,1998, in which you provided information in support of a waiver of fees for processing records subject to your above-referenced Freedom of information Act (FOIA) request. Your request seeks records related to the Operational Safety Team Inspection (OSTI) which was conducted between April 13,1998, and April 24,1998, at the Millstone Nuclear Power Station.
In our May 13,1998, Statement of Estimated Fees, we informed you that the fees for the search, review and duplication of records subject to your request would likely total $2235.00.
However, there will be no charge for the review of records subject to your request because you are a noncommercial requester. Therefore, the estimated fees for the search and duplication of records totals $1253.26. We have enclosed a revised fee estimate which reflects the change.
Your request for a waiver of fees is denied for the following reasons:
(1)
You do not describe the extent to which you will extract and analyze the substantive content of the records you are seeking in order to effectively convey the information to the public.
(2)
It is unclear how the information you are seeking will likely make any new impact on the public's understanding of the subject. Since the final OSTI report has not yet been issued, some of the records subject to your request will likely be withheld from disclosure pursuant to FOIA Exemption 5 because they contain predecisional information such as drafts, opinions and recommendations. Therefore, there is no expectation that any information teleased at this time will be significantly different from information already disclosed at the public meeting recently held on the subject. The OSTI report will be publicly released when it is completed (3)
Merely stating your intent to provide the information you are seeking to public access television or groups is not evidence of your ability to ensure wide dissemination to the public. You do not provide any evidence that either the public access television station or groups are committed to broadcasting this information. Whether these entities you i
intend to disseminate the information to will make it widely available is uncertain.
