18 MR. CHILK: 'The first' paper'is SECY-87-261 It is a 19 final' rule regarding the completeness and accuracy of licensee 20 communication with the NRC.
'21 The commission is being asked to approve publication l
22 of amendments to Appendix C of 10 CFR Part 2 and Parts 30, 40, 23 50, 55, 60. 61, 70, 71, 72, 110 and 150.
These amendments 24 codify.the obligation of licensees and applicants for licenses to provide the Commission with complete ~and accurate 25 3d k

3 4-l' information, to maintain accurate records and to provide for df 2
the disclosure of information-identified by licensees as 3_
significant for licensed activities.
4 Chairman Zech, Commissioners Roberts, Carr and Rogers
- 5 have approved the amendments with changes proposed by Chairman 6
Zech and Commissioner Carr.
Commissioner Bernthal has also I
7 approved the SECY paper and will have additional comments to be 8
- published with the rule and, I believe, desires to address 9
those at this time.
10 COMMISSIONER BERNTHAL:
Well, I just want.to make a 11 brief remark to the original intent of this rule.
I think it's 12 fair to say that no one was an earlier and more vocal, I should 13 7
say, supporter of the idea that we should not be labeling i
14 honest mistakes as lies with the possible exception of 15 Commissioner Roberts, who predate,s all of us by some years.
16 I think that the Commission, following the advice of 17 the Advisory Committee that we impaneled to bring its opinion 18 before us on this issue, is in unanimous agreement on that as l
19 am I.
But, I think we have gone one step too far in this final 20 rule.
,i 21 In a word, my view has been now three times around, 22 that sanctions should be imposed upon applicants and licensees 23 who fail to notify the Commission of significant information 1
1 24 where failure to report is the result of reckless disregard l
